You acknowledge that by purchasing, using on this website and/or downloading a Digital Product via this website or through emails, you are agreeing in full to this disclaimer.

SECTION 1 - USE OF DIGITAL PRODUCT

After you purchase the Digital Product you will be provided with access to the Digital Product. At our discretion we may specify a limited access time.

Upon purchase, we grant you one (1) non-transferable, non-sublicensable, non-exclusive, revocable license to use this Digital Product personally or in your business. However, this Digital Product may not be copied, reproduced, redistributed, altered, modified, shared with a third-party, displayed publicly, transmitted electronically or otherwise used in any way in whole or in part for the purpose of commercial gain by you for any purpose that may amount to competition with us in any way.

SECTION 2 - COPYRIGHT NOTICE

We control the copyright and other intellectual property rights in our Digital Product. We retain all ownership of the copyright of the Digital Product in its original form downloaded by you. If we see you have shared our Digital Product with a third party or used it for commercial use rather than personal or business use, we reserve the right to claim compensation for such unauthorized use.

SECTION 3 - REFUND POLICY

Due to the nature of digital products being immediately accessible upon purchasing, no refunds of any fees or other amounts paid in connection with the Digital Product will be allowed under any circumstances.

SECTION 4 - DISCLAIMER

While we use reasonable commercial endeavors to ensure that the Digital Product is accurate and fit for download, the Digital Products may contain inaccuracies, typos, or other errors. We assume no responsibility for such errors and omissions. All Digital Products are for general interest informational use only. We make no guarantees you will attain a particular result using the ideas presented in the Digital Products. Your purchase and use of our Digital Products do not establish a professional-working relationship between you and B&E Photography, LLC.

SECTION 5- PAYMENT & BILLING

By providing Thinkific (the "Company") with your preferred payment method, you agree that you are authorized to use that payment method. You also authorize the Company to charge that payment method for any fees related to your purchase of the Products, including without limitation fees relating to any paid feature of the Website and/or subscription service of the Company in which you have chosen to enroll (collectively, the “Fees”). If you sign up for a limited time trial-period offer and you do not cancel the service on or before the last day of the trial period, you are authorizing us to charge your payment method for the service. Unless otherwise indicated, all Fees are in United States Dollars (USD).

SECTION 6- CHARGE BACKS

By attempting a chargeback with your financial institution, you are expressly agreeing to pay the full cost of your original purchase, plus any fees or associated costs incurred by the Company. We have the right to present these Terms to your financial institution, any payment processing company and/or investigating agency concerning the attempted chargeback or financial dispute.

SECTION 7-DISCOUNTS & PROMOTIONS

We may occasionally market and/or advertise promotions, discounts, limited time offers, and/or bonuses (“Promotions”) to potential customers. We reserve the right to change or alter any Promotions at any time and at our sole discretion. If you made a purchase of our Products prior to any associated Promotions, we are unable to honor the new offer.

SECTION 8-FEEDBACK CONSENT

By submitting reviews, images, comments, testimonials, or tags (“Submissions”) to us on any platform including, but not limited to social media and online reviews, you are by default granting us a commercial license and voluntarily releasing us to use your Submissions for any reasonable future business use. In doing so, we may use your name and/or photo when referring to your Submissions on our Website, marketing materials, guides, and any other platform not expressed in these Terms.

SECTION 9-PLATFORM SERVER ERRORS & TERMINATION

This website, Thinkific.com, is hosting our digital products and is not part of B&E Photography. Thinkific is a third-party service provider and may have technical difficulties. You are responsible for downloading the course presentations and worksheets. B&E Photography cannot guarantee that Thinkific will hold onto the course indefinitely nor can they guarantee a seamless server experience.

In concluding these Terms, you understand and acknowledge that these Terms constitute the final agreement and supersede all others regarding the purchase, sale, and use of any Products and the use of this platform. B&E Photography reserves any and all rights not expressly granted in these Terms.
